1. Acceptance of Terms
Welcome to VibeCured. These Terms of Service ("Terms") govern your access to and use of the VibeCured website, APIs, and security scanning services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services.
2. Description of Services
VibeCured provides security scanning and vulnerability assessment services for websites, web applications, and code repositories. Our Services include static analysis, dynamic analysis, and full security audits designed to identify potential security vulnerabilities and provide recommendations for remediation.
3. User Accounts and Registration
To access certain features of our Services, you must register for an account. When you register, you agree to provide accurate, current, and complete information about yourself and to maintain and update this information. You are responsible for safeguarding your account credentials and for any activity that occurs under your account.
You may not share your account credentials with any third party or allow any third party to access your account. VibeCured reserves the right to disable any user account if we suspect unauthorized or fraudulent use of the account.
4. Subscription and Payment
VibeCured offers various subscription plans, including a free tier with limited features, and paid tiers with additional capabilities. By subscribing to a paid plan, you agree to pay all fees associated with your chosen plan. All payments are processed securely through our payment processor.
Subscriptions are billed in advance on a recurring basis according to your chosen billing cycle (monthly or annually). You may cancel your subscription at any time, but no refunds will be provided for the current billing period. Upon cancellation, your access to premium features will continue until the end of your current billing period.
VibeCured reserves the right to change subscription fees upon reasonable notice. Any changes to subscription fees will be effective at the start of the next billing cycle.
5. User Content and Authorization
Our Services require you to provide certain content, such as website URLs, code repositories, or other materials ("User Content") for security scanning. By submitting User Content, you represent and warrant that:
- You own or have the right to scan the User Content;
- You have the authority to grant us the rights to scan the User Content;
- The User Content does not violate the rights of any third party; and
- The User Content complies with all applicable laws and regulations.
Important: You must have proper authorization to scan any website, application, or code repository. You may only submit websites, applications, or code repositories that you own or have explicit permission to scan. Unauthorized security scanning may violate computer fraud and abuse laws and could result in civil and criminal penalties.
6. Intellectual Property Rights
All content, features, and functionality of the Services, including but not limited to text, graphics, logos, icons, images, software, and the design, selection, and arrangement thereof, are owned by VibeCured, its licensors, or other providers and are protected by copyright, trademark, patent, and other intellectual property laws.
VibeCured grants you a limited, non-exclusive, non-transferable, revocable license to use the Services for your personal or internal business purposes. You may not copy, modify, distribute, sell, or lease any part of our Services without our written permission.
7. Prohibited Activities
When using our Services, you agree not to:
- Use the Services to scan websites, applications, or code repositories for which you do not have proper authorization;
- Use the Services to engage in any activity that interferes with or disrupts the Services;
- Attempt to gain unauthorized access to any portion of the Services or any other systems or networks connected to the Services;
- Use the Services for any illegal purpose or in violation of any applicable law;
- Attempt to bypass or circumvent any security features of the Services;
- Use the Services to collect or harvest any personally identifiable information;
- Use the Services to transmit any malware, viruses, or other harmful code;
- Use the Services to generate excessive load, flooding, or mail-bombing;
- Impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity;
- Interfere with or disrupt the integrity or performance of the Services;
- Engage in any activity that could disable, overburden, or impair the proper working of the Services.
8. Limitation of Liability
In no event shall VibeCured, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
- Your access to or use of or inability to access or use the Services;
- Any conduct or content of any third party on the Services;
- Any unauthorized access, use, or alteration of your transmissions or content; or
- Any security vulnerabilities that remain undetected by our Services.
VibeCured does not guarantee that our Services will identify all security vulnerabilities in your websites, applications, or code repositories. Our Services are provided as tools to assist in identifying potential security issues, but should not be relied upon as the sole means of securing your systems.
9. Disclaimer of Warranties
The Services are provided on an "as is" and "as available" basis, without any warranties of any kind, either express or implied. VibeCured disclaims all warranties, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
VibeCured does not warrant that:
- The Services will function uninterrupted, secure, or available at any particular time or location;
- Any errors or defects will be corrected;
- The Services are free of viruses or other harmful components; or
- The results of using the Services will meet your requirements or expectations.
10. Indemnification
You agree to defend, indemnify, and hold harmless VibeCured and its licensors, service providers, employees, agents, officers, directors, and affiliates from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:
- Your violation of these Terms;
- Your User Content;
- Your use of the Services, including, but not limited to, any unauthorized security scanning activities; or
- Your violation of any third-party rights.
11. Termination
We may terminate or suspend your account and access to the Services immediately, without prior notice or liability, for any reason, including, without limitation, if you breach these Terms. Upon termination, your right to use the Services will cease immediately. All provisions of these Terms which by their nature should survive termination shall survive, including, without limitation, ownership provisions, warranty disclaimers, indemnification, and limitations of liability.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the courts for the resolution of any disputes.
13. Changes to Terms
VibeCured reserves the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Services after any revisions become effective, you agree to be bound by the revised Terms.
